The transfer pricing landscape is complex and constantly evolving. This is evident by the recent gazetted Income Tax (Transfer Pricing Rules) 2023 which takes effect from year of assessment 2023 and subsequent assessment years. Company personnel are facing an uphill task to understand the technical meaning of transfer pricing principles stipulated by the Malaysia law, and the rules and guidelines that govern companies with controlled transactions. Incorrect information submitted to LHDN attracts additional penalty. The required information by LHDN, in respect to transfer pricing controlled transactions, can be quite daunting to taxpayers (companies), tax managers and the designated personnel who are unfamiliar with the knowledge of transfer pricing principles.
